Bible Reply Terms of Service

1. Acceptance of Terms & Eligibility

By downloading and using Bible Reply ("the App"), you agree to these Terms of Service. If you do not agree, please do not use the App.

You must be at least 18 years old to use the App. The App is not directed to minors, and we do not knowingly collect personal data from anyone under 18; if you believe anyone under 18 has provided personal data, contact us and we will delete it.

2. Description of Service

Bible Reply provides daily Bible verses and AI-generated devotional content for personal encouragement and spiritual reflection. The App is available in English and Chinese.

3. AI-Generated Content

• Devotional content is generated by artificial intelligence and is intended for personal encouragement only.
• AI-generated content does not constitute professional counseling, religious authority, theological instruction, or pastoral advice.
• We do not guarantee the accuracy, completeness, or theological correctness of AI-generated content.
• Users are encouraged to verify content against their own understanding of Scripture and consult with spiritual leaders for guidance.
• If you are in emotional distress or crisis, or have thoughts of harming yourself or others, this App is not a substitute for professional help — please contact a qualified professional or your local emergency services immediately.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Submit content that is offensive, harmful, defamatory, or violates the rights of others.
• Attempt to reverse engineer, decompile, disassemble, or modify the App.
• Use the App in any way that could damage, disable, overburden, or impair our servers or networks.
• Access, scrape, crawl, mine, or extract data from the App by any automated means (bots, scripts, spiders, or similar), or compile its content for use by a competing product or service.
• Use the App, or any content obtained from it, to develop, train, or improve any other artificial-intelligence model or product.

5. Intellectual Property

• The App's design, code, and original content are owned by Bible Reply.
• Bible verses are sourced from public domain translations (World English Bible and Chinese Union Version 1919).
• You may share devotional content for personal, non-commercial purposes.

6. Subscriptions (Auto-Renewable)

The App offers optional auto-renewable subscriptions that unlock Premium features (AI devotionals, daily quota applies): "Premium Monthly" at $9.99/month and "Premium Annual" at $59.99/year, each with a 7-day introductory free trial. The daily Bible verse is free for everyone, and bookmarks are free as well (each account can store up to 50 bookmarks). Prices may vary by region.

• Free trial. Each Premium subscription includes a 7-day introductory free trial. Starting a trial requires a valid payment method and begins when you confirm the purchase; you are not charged during the trial. If you do not cancel at least 24 hours before the trial ends, your Apple ID is automatically charged the subscription price and the subscription renews until cancelled.
• Payment & billing. Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal. The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current billing period.
• Renewal charge. Your account is charged for renewal within 24 hours prior to the end of the current period, at the same subscription price.
• Manage or cancel. You can manage or cancel your subscription at any time in your App Store account settings: https://apps.apple.com/account/subscriptions
• Refunds. Refunds are handled by Apple according to its own policies; we do not issue refunds directly.
• Right of withdrawal (European Union consumers). If you are a consumer in the European Union, you generally have the right to withdraw from a purchase within 14 days without giving a reason. Because the Premium subscription delivers digital content that is supplied immediately and you consent to begin delivery during the withdrawal period, this right may be waived upon your confirmation. Where Apple's App Store terms provide a withdrawal or refund mechanism, that mechanism applies. Otherwise, fees are non-refundable.
• Apple EULA. Your use of the in-app purchase and subscription is also governed by Apple's Standard End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

7. Third-Party Services

The App relies on third-party services to provide its features, including an AI provider (Mistral AI) and Apple's App Store (for purchases and server-side entitlement verification via StoreKit 2 signed transactions). These services are governed by their own terms and privacy policies, which we encourage you to review. We are not responsible for the practices, content, or availability of these third-party services, and your use of them is at your own risk.

8. User Content & License

When you use the AI devotional feature, the text you enter ("User Content") is processed solely to generate your devotional. You retain any rights you have in your User Content. To the extent permitted by law, you grant us a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to process your User Content for the sole purpose of providing and improving the App for you. We do not use your User Content to train AI models, and we do not sell or publish it. It is retained only as part of your devotional history under your account, where you can delete it at any time (see our Privacy Policy for details). You are responsible for ensuring that you have all necessary rights to submit your User Content and that it does not violate these Terms or any applicable law. You may withdraw your consent to this AI processing at any time in the app under Settings ▸ AI Data Use (see our Privacy Policy for details).

9. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. No advice or information obtained from the App creates any warranty not expressly stated in these Terms.

10. Limitation of Liability

To the fullest extent permitted by law, Bible Reply shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. Our total aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the greater of: (a) the amounts you have paid us for the App in the twelve (12) months preceding the claim; or (b) USD $100. The foregoing limitations apply even if a remedy fails of its essential purpose, to the extent permitted by law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Bible Reply harmless from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your User Content, your violation of these Terms, or your misuse of the App.

12. Reporting Inappropriate Content & Copyright

If you believe any content available through the App is unlawful, harmful, or otherwise objectionable, or that it infringes your intellectual-property rights, you may report it to us at jidutu093@gmail.com. For U.S. copyright claims, you may submit a Digital Millennium Copyright Act (DMCA) notice to the same email. We will review reports in good faith and take appropriate action, including removing or disabling access to reported devotional content where warranted, and will respond to valid notices without undue delay.

13. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that harms the service or other users. The App can be used without an account; if you signed in, you can delete your account at any time in Settings, which also removes your server-side bookmarks and devotional history (see our Privacy Policy). Provisions that by their nature should survive termination (such as the disclaimers, limitation of liability, indemnity, and governing law) remain in effect.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where practicable, provide notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved in the state or federal courts located in the State of California, United States, unless you are a consumer entitled under the mandatory consumer-protection laws of your country of residence to bring proceedings in the courts of that country.

16. General

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.

Force majeure. We are not liable for any delay or failure to provide the service caused by circumstances beyond our reasonable control (e.g., hosting outages, network failures, natural disasters).

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App, superseding any prior agreements.

3. AI 生成内容

• 我们不保证 AI 生成内容的准确性、完整性或神学正确性。
• 鼓励用户根据自己对圣经的理解核实内容,并向属灵长者寻求指引。
• 若您处于情绪困扰或危机中,或有伤害自己或他人的想法,本应用不能替代专业帮助——请立即联系合格的专业人士或您当地的紧急服务。

4. 用户行为

您同意不会:

• 将本应用用于任何非法目的。
• 提交冒犯性、有害、诽谤或侵犯他人权利的内容。
• 尝试对本应用进行逆向工程、反编译、反汇编或修改。
• 以任何可能损害、禁用、过载或削弱我们服务器或网络的方式使用本应用。
• 以任何自动化手段(机器人、脚本、爬虫等)访问、抓取、爬取或挖掘本应用数据,或为竞争产品或服务汇编其内容。
• 使用本应用或从中获取的任何内容,来开发、训练或改进任何其他人工智能模型或产品。

5. 知识产权

• 本应用的设计、代码和原创内容归圣经有云 所有。
• 经文来源于公有领域译本(世界英文圣经 WEB 和中文和合本 1919)。
• 您可为个人非商业目的分享灵修内容。

6. 订阅(自动续期)

本应用提供可选的自动续期订阅,解锁 Premium 功能(AI 灵修,每日配额限制):"Premium 月度" $9.99/月、"Premium 年度" $59.99/年,均含 7 天介绍性免费试用。每日经文对所有人永久免费;收藏同样免费(每个账号最多保存 50 条)。价格可能因地区而异。

• 免费试用。每个 Premium 订阅均含 7 天介绍性免费试用。开始试用需有效的付款方式,自您确认购买时开始;试用期内不会扣费。若您未在试用期结束前至少 24 小时取消,您的 Apple ID 将被自动收取订阅费用,订阅将持续续期直至取消。
• 付款与计费。购买确认时,费用将从您的 Apple ID 扣除。
• 自动续期。订阅将自动续期,除非在当前计费周期结束前至少 24 小时取消。

• 退款。退款由 Apple 按其政策处理,我们不直接发放退款。
• 欧盟消费者撤回权。如果您是欧盟消费者,通常有权在 14 天内无理由撤回购买。由于 Premium 订阅提供即时交付的数字内容,且您在撤回期内同意开始交付,该权利可在您确认时视为放弃。若 Apple App Store 条款提供撤回或退款机制,则适用该机制。否则,费用不予退还。

8. 用户内容与许可

当您使用 AI 灵修功能时,您输入的文本("用户内容")仅用于生成您的灵修。您保留您对用户内容的任何权利。在法律允许的范围内,您授予我们一项有限、非排他、不可转让、不可再许可、可撤销的许可,仅为向您提供和改进本应用而处理您的用户内容。我们不会将您的用户内容用于训练 AI 模型,也不会出售或发布它。用户内容仅作为您账号下的灵修历史保留,您可随时在应用内删除(详见隐私政策)。您有责任确保您拥有提交用户内容的所有必要权利,且其不违反本条款或任何适用法律。您可随时在应用内「设置 ▸ AI 数据使用」中撤回对该 AI 处理的同意（详见隐私政策）。

9. 免责声明

本应用按"现状"及"按可用 basis"提供,不附任何明示或暗示的保证。我们不保证本应用将不中断、无错误、安全或不含有害组件,也不保证任何缺陷将被更正。从本应用获得的任何建议或信息,均不产生本条款未明确声明的任何保证。

10. 责任限制

在法律允许的最大范围内,对于因您使用或无法使用本应用而产生的任何间接、附带、特殊、后果性或惩罚性损害,圣经有云 不承担责任。我们就因本条款或本应用引起或相关的任何索赔承担的累计总责任,不超过以下两者中较高者:(a) 您在索赔发生前十二(12)个月内就本应用向我们支付的金额;或 (b) 100 美元。在法律允许的范围内,上述限制在救济未能实现其基本目的时仍然适用。

11. 赔偿

在法律允许的范围内,您同意就因您的用户内容、您违反本条款或您滥用本应用而产生或相关的任何索赔、损害、损失、责任和费用(含合理的律师费),为圣经有云 辩护、赔偿并使其免受损害。

12. 举报不良内容与版权

如果您认为本应用提供的任何内容违法、有害或具有其他不当性,或侵犯您的知识产权,可发送邮件至 jidutu093@gmail.com 举报。对于美国版权主张,您可向同一邮箱提交《数字千年版权法》(DMCA)通知。我们将善意审查举报并采取适当措施,包括在必要时移除或禁用被举报的灵修内容,并在无不当延迟内回复有效通知。

13. 终止

您可随时从设备删除本应用以停止使用。若您违反本条款或以损害服务及其他用户的方式使用本应用,我们可暂停或终止您的使用权限。本应用无需账号即可使用;若您曾登录,可随时在「设置」中删除账号,该操作会同时移除您保存在服务器上的收藏与灵修历史(详见隐私政策)。按其性质在终止后仍应有效的条款(如免责声明、责任限制、赔偿与适用法律)继续有效。

14. 条款变更

我们可能不时更新本条款。若作重大变更,我们将更新上方"最后更新"日期,并在可行时于应用内提示。变更生效后您继续使用本应用,即表示接受更新后的条款。

15. 适用法律

本条款受美利坚合众国加利福尼亚州法律管辖并据此解释,不适用其冲突法规则。因本条款或本应用产生的任何争议,应在美利坚合众国加利福尼亚州的州法院或联邦法院解决;但若您是消费者,且依您居住国强制性消费者保护法律有权在其居住国法院提起诉讼,则可按该等法律在该国法院提起。

16. 一般条款

可分割性。若本条款任何规定被认定无效或不可执行,其余规定仍然完全有效。

不可抗力。对于因我们合理控制之外的情形(如托管服务中断、网络故障、自然灾害)导致的服务延迟或中断,我们不承担责任。

完整协议。本条款连同我们的隐私政策,构成您与我们之间关于本应用的完整协议,取代之前的任何协议。
